Affiliate Terms

Effective date: November 4, 2026

These terms apply to the Kindly Camera Bags Affiliate Program (the "Program"), run by Heather Cluff Photography, doing business as Kindly Camera Bags ("Kindly," "we," "us"). By joining the Program, sharing a Kindly code or link, or accepting a commission, you ("Affiliate," "you") agree to these terms. If you don't agree, please don't take part.

1. ELIGIBILITY AND APPROVAL

You must be at least 18 years old and able to enter a binding agreement. Kindly may approve, deny, pause, or remove any affiliate account at any time, at our discretion. Customers may be enrolled automatically; enrollment does not guarantee a commission, and every commission is subject to these terms.

2. ONE ACCOUNT PER PERSON

Each person or business may hold only one affiliate account. Creating multiple accounts, or accounts with false names, shared or fake phone numbers, shared email domains, or other false details, is not allowed. We may merge, close, or deny commissions on duplicate or false accounts.

3. HOW YOU CAN PROMOTE

You're welcome to share your code or link through your own channels: your social media accounts, your own website or blog, YouTube, newsletters sent to people who opted in, and personal recommendations to friends, family, and clients. Keep it honest and in your own voice.

4. WHAT IS NOT ALLOWED

The following are prohibited:

  • Paid search and brand bidding. Bidding on, or running ads that target, "Kindly," "Kindly Camera Bags," or any similar or misspelled term on Google, Bing, Yahoo, or any other search or ad platform.
  • Trademark use. Using our name or logo in ad copy, domain names, social handles, or app names, or in any way that suggests you are Kindly or officially represent us.
  • Coupon, deal, and cashback sites. Posting or submitting your code or link to coupon, deal, discount, code-aggregator, cashback, rebate, or loyalty sites, or browser extensions that insert codes at checkout.
  • Code leaking. Publicly listing your code anywhere aimed at people already shopping with us, rather than people you've introduced to us.
  • Self-referral. Using your own code or link on your own orders, or orders for your household or for resale.
  • Fake or incentivized orders. Placing, paying for, or encouraging orders made only to generate commission, including offering people money or rebates to use your code.
  • Spam. Unsolicited emails, texts, DMs, or comments, or any messaging that breaks anti-spam laws.
  • Misleading claims. False statements about our products, pricing, discounts, or your relationship with us, or making up reviews.
  • Anything unlawful, hateful, or harmful to Kindly's reputation.

5. DISCLOSURE

You must clearly disclose your relationship with Kindly wherever you promote us, as required by the U.S. Federal Trade Commission (FTC) and the rules of each platform you use. A simple "I earn a commission if you use my code" or "#ad" placed where people will see it before clicking is fine. Hidden or vague disclosures are not enough.

6. COMMISSIONS

You earn 10% commission on qualifying sales made through your code or link. Customers using your code get 10% off. Links track purchases for 30 days after a click, and codes may be used once per customer.

Commission is calculated on the net amount actually paid for products, after discounts, and excluding sales tax, shipping, gift cards, and any amount refunded, returned, cancelled, or charged back. If an order is later refunded or charged back, the related commission is reversed.

Commission rates and Program details may change as described in section 10.

7. HOLD PERIOD

Commissions are held as pending for 21 days after the order is delivered. This covers our 14-day return window plus 7 days to process returns. A commission becomes payable only after the hold ends and the order has not been returned, refunded, cancelled, or charged back.

8. OUR RIGHT TO WITHHOLD OR REVERSE COMMISSIONS

We may withhold, reverse, deny, or claw back any commission that we reasonably believe came from activity that breaks these terms, including paid search, coupon or deal sites, duplicate accounts, self-referrals, or fake orders. If a commission has already been paid for such activity, we may deduct it from future payouts or ask you to repay it. If we remove you for a violation, any unpaid commissions are forfeited.

9. PAYOUTS

Payouts are sent through Tremendous, which may let you choose cash or other reward options. Payable commissions are paid monthly once your balance reaches at least $25. You're responsible for giving accurate payout details. Kindly is not responsible for payments lost because of incorrect details you provide. You are responsible for any taxes on your earnings, and we may ask for tax information (such as a Form W-9) before paying you.

10. CHANGES TO THESE TERMS

We may update these terms or the Program at any time. We'll give you at least 14 days' notice by email or on our affiliate page before material changes take effect. Continuing in the Program after that date means you accept the updated terms. Changes will not reduce commission you have already earned under the earlier terms, unless that commission broke the terms in effect at the time.

11. ENDING PARTICIPATION

You may leave the Program at any time by emailing us. We may end the Program, or your participation, at any time. If you leave, or we remove you for a reason other than a violation, we'll pay commissions that become payable under these terms. If you are removed for a violation, unpaid commissions are forfeited as described in section 8. Once your participation ends, you must stop using your code, link, and our name.

12. INDEPENDENT CONTRACTOR

You are an independent contractor. Nothing in these terms makes you an employee, partner, agent, or joint venturer of Kindly. You may not make promises or sign agreements on our behalf.

13. LIMITATION OF LIABILITY

The Program is provided "as is." To the fullest extent the law allows, Kindly is not liable for indirect, incidental, or consequential damages, or for lost profits, tracking errors, or outages. Our total liability to you will not exceed the commissions paid to you in the 12 months before the claim. You agree to cover any claims, losses, or costs arising from your promotion or your breach of these terms.

14. GOVERNING LAW

These terms are governed by the laws of the United States and the State of Utah, without regard to conflict-of-law principles, consistent with our website Terms & Conditions.
